Key Policies

Please review these terms before continuing.

  1. 1

    GST

    All plan fees, ABV add-ons, and additional services are exclusive of 18% GST. GST shall be charged as applicable on all invoices.

  2. 2

    Plan Validity & Billing

    All plans are billed annually unless otherwise specified. Monthly pricing (if shown) is for reference only.

    Plan validity begins from the date of listing activation and continues for the selected term.

  3. 3

    Plan Changes, Refunds & Cancellation

    Once activated, plans:

    • Cannot be upgraded, downgraded, or converted during the active term
    • Are non-cancellable and non-refundable
    • Do not allow carry-forward of unused features or benefits
  4. 4

    Commission

    Commission is charged only on Nexby-generated bookings, including all successfully completed bookings and provider-initiated cancellations or service failures.

    No commission is charged on user-initiated cancellations unless caused by provider error.

    Commission rates are as defined in the selected plan and confirmed in the Plan Confirmation & Commercial Terms Sheet (PCS).

    Assured Gross Booking Value (GBV)

    GBV is available only with eligible plans (Growth and Pro).

    • Growth Plan: Available as an optional add-on
    • Pro Plan: Available as an optional add-on
    Details

    The assured gross booking value may vary (e.g., up to ₹1,00,000 or higher) depending on the selected package.

    Add-on fee (where applicable) shall be communicated and agreed at the time of onboarding.

    Final assured value, commission applicability, eligibility criteria, and compensation terms shall be governed strictly by Annexure A – Assured Growth Plan Terms.

    Add-On Features & Usage

    Add-on services (Promotions, Shoutouts, Featured Listings, etc.) are available only to active plan subscribers.

    • Included units are provided as per the selected plan
    • Each unit is valid for a limited duration (typically 7 days from activation)
    • Units are non-transferable and subject to availability and platform capacity
    • Unused units expire at the end of the plan term
    Additional Units Pricing
    • ₹699/unit + GST (Growth Plan)
    • ₹499/unit + GST (Pro Plan)

    WhatsApp Communication Feature

    Nexby provides a basic communication utility that enables Service Providers to initiate customer communication via WhatsApp using pre-defined message templates.

    This feature redirects to the Service Provider’s WhatsApp application with the customer’s contact details and message pre-filled.

    Nexby does not provide WhatsApp API integration, automation, message delivery tracking, or centralized messaging within the platform.

    The Service Provider is solely responsible for initiating, managing, and maintaining all customer communications.

  8. 8

    Feature Availability & Fair Usage

    Features are subject to availability, inventory limits, and platform capacity.

    Nexby reserves the right to manage feature allocation (including promotional slots and visibility placements) to ensure fair usage across partners.

    Nexby may provide certain technology tools, including but not limited to Property Management System (PMS), Channel Manager integrations, Billing/POS systems, booking dashboards, CMS tools, and reporting or print formats (including invoices, receipts, and summaries).

    These tools are provided solely as facilitative software utilities for operational convenience. The Service Provider may choose to use or not use such tools based on their operational preference and plan availability. Nexby shall not be held responsible for any errors, discrepancies, or operational issues arising from the usage, misuse, or non-usage of these tools.

    Custom Plans & Exceptions

    In certain cases, customized features, pricing, or commitments may be offered.

    All such deviations:

    • Must be documented in writing
    • Will be governed exclusively by Annexure B – Custom Plan
    • Shall override standard plan inclusions where applicable
  10. 10

    Plan Revisions (Future Only)

    Nexby reserves the right to revise pricing, features, and plan structures.

    Such changes:

    • Apply only to new or renewed plans
    • Do not affect active plans during their validity

    Platform Scope

    Standard Plan provides only basic PMS tools and does not include Nexby listing or booking capabilities.

    Growth and Pro Plans enable visibility, demand generation, and booking functionality through the Nexby platform.

    Nexby does not independently list Service Providers on third-party Online Travel Agencies (OTAs). The responsibility for creating and maintaining OTA listings lies solely with the Service Provider. Nexby may, where supported, provide integrations or tools to help manage inventory, pricing, and availability across connected OTAs from a centralized dashboard. Such integrations are limited to supported platforms and are facilitative in nature.

  12. 12

    Acceptance of Terms

    By proceeding with onboarding, payment, or activation, the Service Provider confirms that:

    • All pricing, features, and policies displayed on the platform have been reviewed and accepted as indicative of the selected plan
    • Final commercial terms, scope, and commitments shall be governed strictly by the executed Service Provider Agreement, including the Plan Confirmation & Commercial Terms Sheet (PCS) and applicable Annexure(s), if any
    • Payment made through the platform or payment gateway shall be treated as a confirmation of the selected plan and commercial intent, and shall be duly reflected in the final onboarding documentation
    • In cases where payment is completed prior to execution of the formal agreement, Nexby’s onboarding team shall connect with the Service Provider to complete documentation, verification, and onboarding formalities
    • Any plan-specific customizations, negotiated terms, or deviations (if applicable) shall be mutually agreed and documented in writing (including PCS, Annexure, or official onboarding communication) and shall prevail accordingly
    • In case of any conflict, the terms documented in the executed PCS and applicable Annexure shall prevail over general plan descriptions, to the extent of such agreed customization
